Welcome to BRB Apparel. These Terms of Service (“Terms”) govern your access to and use of the BRB Apparel website, online store, and any products or services offered through the website (collectively, the “Store”).

The Store is operated by BRB Apparel (“BRB Apparel,” “we,” “us,” or “our”). By accessing or using our Store, placing an order, or purchasing a product from us, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Store or purchase our products.

1. ABOUT BRB APPAREL

BRB Apparel operates an online clothing and apparel store. Products available through the Store may include, but are not limited to, shirts, hoodies, sweatshirts, hats, accessories, and other apparel or merchandise.

Our Store is operated using Shopify. Shopify provides the e-commerce platform that allows us to sell our products and process customer orders. Shopify is not the seller of BRB Apparel products and is not responsible for the products, fulfillment, customer service, or other obligations provided by BRB Apparel.

2. ELIGIBILITY

You must be legally capable of entering into a binding agreement to use the Store or make purchases.

If you are under the age required to enter into contracts in your jurisdiction, you may only use the Store with the involvement and permission of a parent or legal guardian.

By using the Store, you represent that the information you provide is accurate and that you will use the Store in compliance with all applicable laws and regulations.

3. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to accurately display our products, including their descriptions, colors, sizes, images, and other characteristics.

However, colors displayed on your device may differ slightly from the actual color of a product.

Product availability may change at any time. We reserve the right to limit quantities, discontinue products, modify product designs, or remove products from the Store at any time.

We also reserve the right to correct errors, inaccuracies, or omissions in product descriptions, pricing, availability, or other Store information.

4. PRICING AND PAYMENTS

All prices are displayed in U.S. dollars unless otherwise stated.

Applicable taxes and shipping costs will be displayed during checkout.

We reserve the right to change product prices at any time.

Payments are processed through Shopify and/or third-party payment processors made available through the Store. By placing an order, you authorize the applicable payment processor to charge your selected payment method for the total amount of your purchase.

We reserve the right to refuse or limit transactions when we reasonably believe that a transaction involves fraud, unauthorized activity, an error in pricing, unauthorized resale activity, or a violation of these Terms.

5. ORDERS

When you place an order through the Store, you agree to provide accurate and complete billing, shipping, and contact information.

You are responsible for ensuring that all information submitted during checkout is accurate.

An order confirmation or electronic receipt confirms that we have received your order information but does not necessarily constitute acceptance of the order.

6. SHIPPING AND DELIVERY

We ship products to the locations available during checkout.

Shipping costs and estimated delivery times will be displayed during checkout whenever available.

Delivery estimates are estimates only and are not guaranteed unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather, natural disasters, holidays, customs delays, or other transportation disruptions.

You are responsible for providing an accurate shipping address.

BRB Apparel is not responsible for delays or additional costs resulting from an incorrect or incomplete shipping address provided by the customer, to the extent permitted by applicable law.

7. DAMAGED OR DEFECTIVE PRODUCTS

Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable law.

8. INTELLECTUAL PROPERTY

All intellectual property associated with BRB Apparel, including but not limited to its trademarks, logos, slogans, brand names, product designs, graphics, photographs, illustrations, website content, product descriptions, videos, and other original materials (collectively, the “BRB Apparel Intellectual Property”) is owned by or licensed to BRB Apparel and is protected by applicable intellectual property laws.

This includes all registered and unregistered trademarks, service marks, trade names, logos, slogans, and other brand identifiers used by BRB Apparel.

Except as expressly permitted by BRB Apparel in writing or by applicable law, you may not:

  1. Copy, reproduce, modify, or distribute any BRB Apparel Intellectual Property;

  2. Use any BRB Apparel trademark, logo, slogan, or other branding for commercial purposes;

  3. Manufacture, sell, distribute, or promote products bearing BRB Apparel Intellectual Property without authorization;

  4. Use BRB Apparel branding in a manner that suggests sponsorship, endorsement, affiliation, partnership, or authorization;

  5. Register or attempt to register any trademark, business name, domain name, social-media account, or other identifier that is confusingly similar to BRB Apparel's trademarks;

  6. Create derivative works based on BRB Apparel designs, logos, graphics, or other protected materials;

  7. Remove, alter, obscure, or falsify any copyright, trademark, or other proprietary notices associated with BRB Apparel; or

  8. Use BRB Apparel Intellectual Property in connection with counterfeit, unauthorized, or infringing merchandise.

Nothing in these Terms grants you ownership of or any rights in BRB Apparel Intellectual Property except for the limited right to personally use products you have lawfully purchased from the Store.

BRB Apparel reserves all rights not expressly granted under these Terms.

9. TRADEMARKS AND BRAND PROTECTION

BRB Apparel, its logos, slogans, designs, and other identifying marks are trademarks of BRB Apparel and are protected under applicable trademark laws.

BRB Apparel's trademarks and other protected branding may include marks that are federally registered, state registered, or otherwise protected under applicable law.

Unauthorized use of BRB Apparel trademarks, logos, slogans, or other protected branding may constitute trademark infringement, unfair competition, dilution, false designation of origin, or other violations of applicable law.

You may not use BRB Apparel's trademarks, logos, slogans, or other brand identifiers without prior written authorization from BRB Apparel, including in connection with:

  1. Clothing or merchandise;

  2. Online stores or marketplaces;

  3. Websites or domain names;

  4. Social-media accounts or usernames;

  5. Advertising or promotional materials;

  6. Business names or trade names;

  7. Product listings;

  8. Digital or physical artwork;

  9. Artificial intelligence-generated content or designs; or

  10. Any other commercial activity.

Nothing in these Terms grants any license or other right to use BRB Apparel's trademarks.

BRB Apparel reserves the right to take appropriate legal action against unauthorized use of its intellectual property, including seeking available injunctive relief, damages, recovery of profits, attorneys' fees where available, and any other remedies provided by applicable law.

10. USER CONTENT AND REVIEWS

If the Store allows you to submit reviews, photographs, comments, social media content, or other materials (“User Content”), you retain ownership of your User Content.

By submitting User Content to BRB Apparel, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, distribute, and modify that User Content for purposes related to operating, promoting, and marketing BRB Apparel.

You represent that you have the necessary rights to submit the User Content and that your User Content does not violate the rights of another person or entity or applicable law.

We reserve the right to remove User Content that we believe violates these Terms or is otherwise inappropriate.

11. PROHIBITED USES

You agree not to use the Store:

  1. For any unlawful purpose;

  2. To commit or facilitate fraud;

  3. To impersonate another person or business;

  4. To interfere with the operation or security of the Store;

  5. To introduce viruses, malware, or other harmful code;

  6. To attempt to gain unauthorized access to the Store or related systems;

  7. To scrape, copy, or reproduce substantial portions of the Store without permission;

  8. To infringe or misappropriate our intellectual property or the intellectual property of another person;

  9. To use automated systems to place unreasonable numbers of orders;

  10. To purchase products for fraudulent purposes;

  11. To resell products using BRB Apparel branding without authorization;

  12. To create counterfeit BRB Apparel products or merchandise;

  13. To use our trademarks or branding to create an appearance of affiliation with BRB Apparel without authorization; or

  14. To otherwise interfere with another person's ability to use the Store.

We reserve the right to refuse service to users engaging in prohibited or fraudulent activity.

12. THIRD-PARTY SERVICES

Our Store may use third-party services, applications, payment processors, shipping providers, analytics services, or other technologies, including services provided through Shopify.

Your use of third-party services may be subject to the third party's own terms and privacy policies.

We are not responsible for the independent actions, policies, or practices of third-party services to the extent permitted by applicable law.

13. PRIVACY

Your use of the Store is also subject to our Privacy Policy, which explains how we collect, use, store, and disclose information.

Our Store may use Shopify and other service providers to process orders, payments, shipping information, customer service requests, analytics, and other information necessary to operate the Store.

Our Privacy Policy is incorporated into these Terms by reference.

14. DISCLAIMERS

To the fullest extent permitted by applicable law, the Store and its content are provided on an “AS IS” and “AS AVAILABLE” basis.

We do not guarantee that the Store will always be available, uninterrupted, secure, or error-free.

We do not guarantee that product descriptions, images, pricing information, or other Store content will always be complete, accurate, or current, although we make reasonable efforts to keep such information accurate.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot legally be excluded or limited under applicable law.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, BRB Apparel and its owners, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Store or purchase or use of our products.

To the fullest extent permitted by applicable law, our total liability arising from any claim relating to a purchase will not exceed the amount you actually paid for the product giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

16. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless BRB Apparel and its owners, employees, contractors, agents, affiliates, and service providers from claims, damages, liabilities, losses, and reasonable expenses arising out of:

  • Your violation of these Terms;

  • Your unlawful use of the Store;

  • Your violation of another person's rights; or

  • Your misuse of the Store or its content.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time.

When we make changes, we will update the “Last Updated” date at the beginning of these Terms. Changes will become effective when posted to the Store unless otherwise stated.

Your continued use of the Store after changes are posted constitutes acceptance of the revised Terms, to the extent permitted by law.

18. GOVERNING LAW

These Terms will be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent applicable federal law or mandatory consumer protection laws provide otherwise.

Any legal proceeding arising out of or relating to these Terms or the Store shall be brought in a court of competent jurisdiction as permitted by applicable law.

19. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

20. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies expressly incorporated into these Terms, constitute the entire agreement between you and BRB Apparel regarding your use of the Store and your purchases from us.
